Enterprise AI – Terms of Service

Terms of Service for Enterprise AI

Effective Date: October 3, 2024

1. Acceptance of Terms

By using the services of Enterprise AI, the user agrees to these Terms of Service. If the user does not agree with these terms, they should not use our services.

2. Service Information

Enterprise AI, created by WEBSENSA sp. z o.o., located at Marszałkowska 76, 00-517 Warsaw, provides access to advanced AI models such as ChatGPT, Claude, and Gemini, enabling innovation and optimization of workflows.

3. Definitions

  • Service: The services provided by Enterprise AI, including access to AI models.
  • User: An individual utilizing the services of Enterprise AI.
  • Account: The user’s personal account within the Enterprise AI system.
  • Content: Any data, information, text, images, and other materials that the user submits or generates while using the service.

4. User Obligations

The user agrees to:

  • Use the service in compliance with applicable laws and regulations.
  • Not share their account with others.
  • Not engage in actions that may harm the functioning of the service.
  • Not use the service for illegal purposes or in a manner that may violate the rights of other users.
  • Ensure that the submitted data is lawful.

5. License to Use

WEBSENSA sp. z o.o. grants the user a limited, non-exclusive, non-transferable license to use the service solely for personal or business purposes, in accordance with these terms.

6. Liability

WEBSENSA sp. z o.o. is not liable for any losses, damages, or irregularities resulting from the use of the Enterprise AI service, including financial losses, data loss, or other technical issues. In the event of damages resulting from the use of the service, WEBSENSA sp. z o.o.’s liability is limited to the maximum amount the user has paid for the service in the last 12 months.

Additionally:

  • The user acknowledges that Enterprise AI may contain user-generated data and content from external sources. WEBSENSA sp. z o.o. is not responsible for the accuracy, completeness, or quality of such data and content. The user uses them at their own risk.
  • WEBSENSA sp. z o.o. is not liable for any interruptions in the availability of the Enterprise AI service caused by external factors such as system failures, hacking attacks, network outages, or other events beyond the company’s control.
  • WEBSENSA sp. z o.o. is not liable for user actions on the platform, including their interactions with other users or any inappropriate behavior that may occur on the platform.
  • WEBSENSA sp. z o.o. is not responsible for decisions made based on information obtained from AI models. Users are responsible for any decisions made based on the results provided by Enterprise AI.
  • The user agrees not to use the Enterprise AI service unlawfully, and WEBSENSA sp. z o.o. is not liable for any illegal actions taken by the user or for the consequences arising from such use.
  • The Enterprise AI service may contain links to external websites. WEBSENSA sp. z o.o. is not responsible for the content posted on those sites or for their availability. Use of such links is at the user’s own risk.

7. Intellectual Property

All rights to the software and content available on Enterprise AI are reserved. The user has no right to reproduce, distribute, or modify this content without the written consent of WEBSENSA sp. z o.o.

8. Personal Data Processing

The user acknowledges that personal data is processed in accordance with the Enterprise AI Privacy Policy. Details regarding data processing can be found in the Privacy Policy.

9. Data Transfer to External Service Providers

The user agrees that, in order to provide Enterprise AI services, their messages and data may be transmitted to external providers such as Google, OpenAI, and Anthropic. WEBSENSA sp. z o.o. is not responsible for the data transmitted to these entities and for their storage and potential deletion.

10. Termination Conditions

The user may terminate the use of the service at any time by deactivating their account. WEBSENSA sp. z o.o. reserves the right to suspend or terminate the user’s account in the event of a breach of these terms.

11. Complaints and Returns

Any complaints regarding the services should be reported to the email address: iod@websensa.com. WEBSENSA sp. z o.o. will handle complaints in accordance with applicable laws.

12. Governing Law

These Terms of Service are governed by Polish law. Any disputes arising from the use of the service will be resolved by the common courts competent for the seat of WEBSENSA sp. z o.o.

13. Changes to the Terms

WEBSENSA sp. z o.o. reserves the right to change these Terms of Service at any time. The user will be notified of significant changes via email or through notifications in the application.

14. Consent to Communication

The user consents to receive information regarding the services, including updates and notifications about changes. The user has the right to opt out of communication.
